Introduction

These Terms and Conditions ("Terms") govern your use of the websites givemysong.com and givemysong.co.uk (collectively referred to as "the Website") and any services offered by Give My Song, a sole trader entity ("we", "us", "our"). By using the Website and our services, you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions.

Services

Give My Song provides personalised songs based on customer input. We request information such as names, hobbies, music preferences, and a favourite artists to create a unique, custom song for personal use. Each song is crafted with care, reflecting the details provided by the customer.

Pricing and Payment

The price for a personalised song will be clearly displayed on the Website. Payment must be made in full before any work begins. Payments are processed securely through trusted payment gateways. We do not store payment information on our servers.

Delivery Timeframes

We aim to provide 2 sample songs within 3 working days of receiving an order (excluding weekends and public holidays). The cut off for orders is 1pm UK time on any working day with a working day being categorised as Monday through to Friday. To ensure we can give each order the attention it deserves, any order placed after 1pm UK time will be treated as having been received at 9am the next working day. This allows us to manage our workflow effectively and provide the best service possible.

We aim to provide your final song, lyrics and artwork within 1 working day of receiving details of your sample preference.

During busier periods, we reserve the right to extend delivery timeframes. However, we will always strive to complete your song in a timely manner, with a focus on delivering quality work as quickly as possible. Should any delays occur, we will inform you promptly.

If revisions are requested, the timeline for completion will be at our discretion.

Personal Use and Copyright

All songs created by Give My Song are for personal use only. Customers may not sell, distribute, or use the song for commercial purposes. Copyright for all songs remains with Give My Song. By purchasing a song, customers receive a non-transferable, non-exclusive licence to use the song for personal enjoyment.

All content, materials, and images created and uploaded to this website (the "Site") are the intellectual property of Give My Song or its licensors, and are protected by UK copyright laws. We retain the copyright to any original content created on this Site.

Unauthorised use, reproduction, distribution, or modification of any materials on this Site is strictly prohibited without prior written permission from Give My Song. For permissions, please contact us at givemysong@outlook.com.

Refusal of Service

We reserve the right to refuse service for any request that does not align with our company values. Give My Song is dedicated to creating positive, uplifting songs. We will not fulfil requests that are negative, offensive, or harmful in nature.

Refund Policy

Due to the personalised nature of our service, Give My Song does not offer refunds. However, if a customer has a valid issue, we encourage open communication and will do our best to resolve the situation at our discretion.

Unique Content Guarantee

Every song is uniquely crafted based on the details provided by the customer. We do not use repeated or recycled content. Each song is an original creation, tailored specifically to the customer’s request.

Song Retention Policy

Your unique song will be retained on our server for a minimum period of 4 weeks from the date of delivery. Any extra retention after this will be at our discretion.

Intellectual Property

All content produced by Give My Song, including but not limited to the lyrics, melodies, and recordings, is the intellectual property of Give My Song. Customers do not have the right to sell or distribute the song beyond personal use.

Technology Usage

At Give My Song, we utilise licensed technologies and digital tools to create your custom songs.

• Licensing: All technologies used in the creation of songs are licensed, allowing us to legally produce and sell the final product. The copyright of the music created belongs to Give My Song, and you, as the customer, receive a personal licence to use the song.

• Final Ownership: While AI and digital tools assist in the creation of your song, the final intellectual property remains with Give My Song.

• Song Ownership & Restrictions: Customers receive a non-transferable, non-commercial licence for personal use only. The following restrictions apply:

  • The song cannot be resold or used for commercial purposes without explicit permission from Give My Song.

  • Broadcasting or public performance of the song is not permitted without prior approval.

Site Usage Policy

By accessing and using this Site, you agree to adhere to the following terms:

1. Prohibited Activities: You agree not to engage in any of the following prohibited activities:

• Using the Site for any unlawful purpose or in violation of any local, national, or international law.

• Transmitting any material that is abusive, harassing, defamatory, obscene, or otherwise objectionable.

While we strive to provide high-quality songs, satisfaction is subjective. Give My Song is not liable for any dissatisfaction or perceived shortcomings in the final product. We are not responsible for any indirect, incidental, or consequential damages arising from the use of our services or the Website.

• Verification: By default, the final song will be sent to the purchaser to forward to the recipient, thus allowing then to ensure it is suitable for sharing. If the purchaser prefers, they may opt for us to send the song on their behalf but this would only be after the purchaser has verified that they are happy with the content. And in that circumstance, the purchaser accepts full responsibility for how the content is received and the satisfaction of the recipient. The purchaser is responsible for notifying us of any adjustments within three working days.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon being posted on the Website. Continued use of the Website or our services constitutes acceptance of the updated Terms.
